How does Mediation work?

How does Mediation work?

At the first session, I will meet with each of you individually to assess whether there are any obstacles to mediation, and establish your objectives. If mediation is suitable and you are both willing to engage in the process then a joint mediation session can start immediately, or at a later date. Each session usually lasts 2 hours, although this is flexible and can be less or more depending on what you both want.

It is usual for you both to be in the same room for the mediation session. You both set the agenda and pace for the mediation sessions. You will have an opportunity to suggest a proposal during the sessions and retain control over whether or not to settle the dispute and on what terms. This can be related to financial and/or child related matters.

In order for the mediation process to be effective, I encourage you both to approach the session with a flexible mindset and demonstrate a willingness to compromise with each other.

As a guide, mediation about financial matters involves at least 3 sessions as it is necessary to have an exchange of financial disclosure. Sometimes the instruction of a single joint expert to value a property or a business is required.  In relation to discussing the children’s arrangements this can be anywhere between 1 and 3 sessions, sometimes more.

About Kate

I am an experienced and specialist family mediator. I have also practiced as a family solicitor for 7 years and represented husbands, wives, mothers, and fathers. Being a solicitor-trained mediator provides a huge benefit to clients going through a separation as I bring a wealth of information about the legal process and the current thinking of the family court.

If you would like further information about the mediation process, please do not hesitate to telephone me on 01959 580680.
