I heard recently that a lottery winner had to pay millions to his wife even though they were divorced. Why was that?

Solicitor and Managing Director

It is true that a lottery winner was recently ordered to pay £2million to his ex-wife! Having won about £56 million on the lottery, his ex-wife saw the publicity and consulted her Solicitors.

It may seem unfair but although they were divorced, there was no Court Order made within the divorce settling financial matters. This meant it was open to his ex-wife to come back and make a claim even after divorce.

It is vital when a divorce goes through, that the financial side of the marriage is settled by a Court Order. This order sets out what has been agreed but also includes an important clause which prevents either party from making future claims against the other. If this order with this clause had been in place then this lucky lottery winner would not have had to pay any money to his ex-wife, however much he had won.

This doesn't just apply to lottery wins but to any money you have and in particular should you inherit money there could be a claim. So if you are divorced check your paperwork to make sure you are protected by a Court Order and that you can hang on to your money!!
